The Clerk & Master’s Office is responsible for Chancery Court and Probate Court. Examples of cases filed in Chancery Court are: orders of protections, divorces, adoptions, guardianships, conservatorships, partition suits, petitions for child support, petitions for change of custody, name changes, delinquent solid waste lawsuits and delinquent tax suits for the city and county. The Clerk & Master is responsible for probate matters which include: appointing executors and administrators, setting and taking bonds, receiving claims and final settlements.
The delinquent county and city tax lawsuits are filed in April each year. After the lawsuits are filed there are additional court costs and attorney’s fees in addition to the base tax and interest & penalty. We attempt to notify the owners first by certified mail, then through the Sheriff’s Department, and finally by newspaper publication. The delinquent tax sale is held at the courthouse during February or March each year.
The lawsuits for delinquent 2007 city and county taxes (real and personal) have been filed. Summons are being issued to the property owners. January 1, 2010, a title search fee of $150 will be added to all unpaid properties. January 15, 2010, a Default Judgment will be taken and a $100 sale fee will be added. The delinquent tax sale will be held at noon at the Maury County Courthouse on March 11, 2010. Lists of unpaid properties will be publicized in the Daily Herald and posted on this website. Personal checks will not be accepted to pay taxes for the month before the sale nor will they be accepted at the sale. You must do your own research before you bid at the tax sale!
The Clerk & Master is occasionally appointed as Special Master to auction other properties in partition suits and other judicial sales. Those sales are publicized in the newspaper and on this website. The auction is usually held on the property.
